Terms of Service

1. Acceptance of terms
By accessing or using FleetMark ("the Service"), you agree to these Terms of Service. If you do not agree, do not use the Service.
2. Description of service
FleetMark is a web-based platform for creating digital vehicle condition reports. The Service includes vehicle data lookup via the DVLA, number plate recognition, damage recording, PDF report generation, and related features.
3. Account registration
You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials. You must be at least 18 years old to use the Service.
4. Acceptable use
You agree to use the Service only for its intended purpose — recording vehicle condition. You must not:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorised access to other users' data
- Upload malicious content or attempt to compromise the platform
- Resell access to the Service without our written consent
5. Data ownership
You retain ownership of all data you create using the Service, including reports, photographs, and organisational information. We do not claim ownership of your content.
6. Service availability
We aim to keep the Service available at all times but do not guarantee 100% uptime. The Service is currently in beta and may contain bugs or undergo changes without notice.
7. Beta programme
During the beta period, the Service is provided free of charge. We reserve the right to introduce pricing at the end of the beta period. We will provide reasonable notice before any pricing changes take effect.
8. DVLA data
Vehicle data retrieved from the DVLA VES API is provided for the purpose of vehicle identification during condition reporting. This data is subject to the DVLA's own terms and conditions.
9. Report immutability
Once a condition report is submitted, it cannot be edited or deleted by users. This is by design — it creates a tamper-proof audit trail. If you need to correct information, create a new report.
10. Limitation of liability
The Service is provided "as is" without warranty. We are not liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability is limited to the amount you have paid us in the 12 months preceding the claim.
11. Termination
You may close your account at any time by contacting us. We may suspend or terminate your account if you violate these terms.
12. Governing law
These terms are governed by the laws of England and Wales.
